Website – the website available at https://neuralspike.ai/, which is equipped with an SSL certificate that encrypts data to ensure the security of Personal Data and the security of its transmission. If you see a closed padlock symbol on our Website, it means that the data of our Website Users is properly secured.

For convenience, in the rest of this Policy we will refer to ourselves as the "Controller" or "Company". We mean the same thing when we use pronouns such as "we", "our", etc. 

PURPOSES AND LEGAL BASIS FOR PROCESSING

The Controller collects Users' personal data to the extent necessary to provide services via the Website. The specific purposes of processing Users' personal data are described below. The provision of personal data by Users is voluntary, but in some cases it may be necessary for the User to use our services.

We process your personal data (name, surname, e-mail address, telephone number) if you contact us via:

  • traditional mail,

  • e-mail correspondence,

  • the contact form on the Website, 

  • our social media profiles,

  • other means made available by the Controller.

If you send us an enquiry, your personal data will be processed solely for the purpose of communication in connection with the handling and resolution of the matter to which the correspondence relates – in connection with the Controller's legitimate interest within the meaning of Article 6(1)(f) of the GDPR, consisting in conducting correspondence in the course of customer service or in connection with its business activities.

The Controller processes only personal data relevant to the matter to which the correspondence relates. The data is processed for the period necessary to complete the handling of your enquiry.

  1. Social media activity

We post information about our services, including information about current offers related to our business and the development of our business, on our social media pages: LinkedIn and GitHub. In this regard, we process personal data for the purpose of:

  • run our fan page - in connection with the legitimate interest of the Controller within the meaning of Article 6(1)(f) of the GDPR, consisting in running a profile, promoting the Controller's brand, products and services, building and maintaining a community associated with the Controller, and communicating with other users of the website;

  • collecting analytical and statistical data – in connection with the Controller's legitimate interest within the meaning of Article 6(1)(f) of the GDPR, consisting in analysing the functioning, popularity, use and reach of the profile;

  • carrying out marketing activities through an advertising system linked to the fan page, which is offered by the social network provider – based on the voluntary consent of the user of the social network (Article 6(1)(a) of the GDPR).

On our Website, you can find social plugins that will redirect you to our profile on the selected social networking site. They are only active when you click on them and log in to your social networking account. The providers of the plugins are:

  1. Controller's marketing

The Controller may process personal data for the purpose of marketing its own products and services or those of third parties. In this regard, personal data will be processed for the purpose of:

  • displaying marketing content on the Internet - in connection with the Controller's legitimate interest within the meaning of Article 6(1)(f) of the GDPR, consisting in conducting marketing and remarketing campaigns on the Internet;

  • displaying marketing content corresponding to your interests in connection with profiling based on cookies (behavioural advertising, personalisation) - on the basis of the User's consent (Article 6(1)(a) of the GDPR) to the collection of cookies, and also in connection with the legitimate interest of the Controller within the meaning of Article 6(1)(f) of the GDPR, consisting in conducting marketing and remarketing campaigns on the Internet and better matching the displayed content to the individual preferences and interests of the User;

  • sending commercial information about goods or services offered by us or our business partners by electronic means (to an e-mail address) and conducting telemarketing activities (MMS/SMS or telephone calls) – on the basis of consent (Article 6(1)(a) of the GDPR);

  • conducting analytical and statistical activities, as well as activities related to the direct marketing of goods and services – in connection with the legitimate interest of the Controller within the meaning of Article 6(1)(f) of the GDPR, consisting in conducting analyses of the effectiveness of marketing campaigns carried out by the Controller and assessing the attractiveness of the content provided.

If, in connection with its marketing activities, the Controller uses analytical solutions and tools developed by external entities, you will be informed of this in an update to our Policy.

  1. Compliance with legal obligations

Our contact with you may involve the processing of personal data in connection with the fulfilment of our legal obligations, e.g. in connection with the exercise of the rights of data subjects, settlements or the sending of communications to which the Controller is obliged by law (including in the event of a data security incident). In this case, the processing of personal data is carried out on the basis of Article 6(1)(b) or (c) of the GDPR.

If necessary, your personal data will be processed in order to enable the pursuit of claims, in particular in the event of use of the Website in a manner inconsistent with the law, security rules or good manners. We may also store your data if it is necessary to collect evidence in a dispute arising from your report. In this regard, we will process your personal data in connection with the legitimate interest of the Controller within the meaning of Article 6(1)(f) of the GDPR in relation to the pursuit or defence of claims.

PROCESSING TIME

The period of data processing by the Controller depends on the type of service provided and the purpose of processing.

Personal data processed for the purpose of:

  • responding to a request via the contact form will be processed for the period necessary to respond to the enquiry or consider the complaint;

  • fulfilling the obligation imposed on the Controller by law will be stored until the obligation is fulfilled, unless the law requires further storage of such data;

  • concluding and performing a contract, the data will be processed until the contract is terminated;

  • pursuing the legitimate interests of the Controller, in particular statistical and analytical data, will be processed for a period enabling the pursuit of those interests or until the User effectively objects to their processing.

If the processing is based on consent, the data shall be processed until the consent is effectively withdrawn. Withdrawal of consent shall not affect the lawfulness of data processing in the period prior to its withdrawal.

If certain messages may constitute or constitute evidence in proceedings before a court or other authority, they will be stored until the end of the limitation period for any claims or until the final conclusion of the proceedings, if any, whichever occurs later.

The data will also be deleted when it is no longer necessary for the purposes for which it was collected.

We take data security very seriously and fulfil the obligations imposed on controllers by the GDPR, including the use of appropriate technical and organisational measures to ensure that personal data is processed in accordance with the law. 

However, the Controller will not make decisions based on automated processing that will have legal effects on you or similarly significantly affect you. However, due to the use of programming solutions, your personal data may be subject to automatic processing, including in connection with the use of software that uses artificial intelligence mechanisms. 

Personal data will generally be processed within the European Economic Area, and the Controller will not transfer personal data to third countries or international organisations. However, in connection with the use of programming and internet services, data may be transferred to a third country independently of the Controller's will, which results from the regulations of the providers of these services. However, you should be aware that in such a situation, the transfer of data is carried out in accordance with all the requirements set out in Chapter V. GDPR and may only take place if an adequate level of data protection is ensured, e.g. by the European Commission recognising that the level of data protection is adequate or, for example, on the basis of standard contractual clauses adopted by the European Commission.

USER RIGHTS

You have the right at any time to:

  • access your data,

  • rectify your data,

  • modify your data.

  • restrict the processing of your data,

  • erase your data,

  • transfer of data processed in an automated manner on the basis of the User's voluntary consent or processed in an automated manner if their processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

If you consent to the processing of your Personal Data, please note that your consent is given voluntarily. You have the right to withdraw your consent at any time. Please note, however, that the withdrawal of your consent does not affect the processing carried out by us prior to its withdrawal.

You also have the right to object to the processing of your data, in particular where 

  • the processing is carried out for the purpose of direct marketing – if the User exercises this right, we will immediately cease processing their personal data for this purpose,

  • the processing is carried out for the purposes of the legitimate interests pursued by the Controller – if the User exercises this right, we will immediately cease processing their personal data, unless we are able to demonstrate that there are valid legal grounds for further processing of the data that override the interests, rights or freedoms indicated by the User.

If the User exercises one of the above rights, the Controller will immediately take action to remove the non-compliance in the processing of personal data.
